Please read these terms and conditions (‘Terms of Use’) carefully as they govern your use of the Conversation Cards website, designed by Neami Limited, ABN 52 105 082 460 (‘Neami’).
By creating a Conversation Cards account, you agree to these Terms of Use.
If you do not agree with these Terms of Use, you must cease your use of the website.
Purpose of the website
The Conversation Cards were developed to support people to build their capacity in self-advocacy and empower agency in conversations and to support professionals to facilitate safer, more person-centred support conversations.
The Conversation Cards are a practice tool designed for private and reflective use for an individual or to support a conversation between a participant and health professional. The card responses will not be monitored by Neami and Neami is unable to provide any direct support to participants or respond to requests or concerns written in the users “Responses” in their account.
The website aims to prompt account holders to:
- Discuss safety, relationship building and agreements about ways of working together
- Try new ways of talking about common topics such as goal planning and NDIS
- Consider their preferences about how they talk about their own life, goals and needs
- Consider the use of language in more intentional way
- Type responses to ideas and prompts into the cards to share with others
Privacy
Neami will collect and record the following information as a result of your use of Conversation cards
- Your name
- Your email address
- Your responses to the questions contained within the Cards
- Your data will be held according to applicable Australian State and Commonwealth law and the terms of the Neami Conversation Cards Privacy Notice.
Please note, information collected from you in the website is done so to allow you to review previous responses and may be stored indefinitely. You may contact Neami and request this information be deleted at any time.
Neami reserves the right to use de-identified information for the purpose of research and evaluation. This information will not include your name, email address or identifying information.
By agreeing to these Terms of Use, you agree to the ‘Conversation Cards Privacy Statement’.
Use of the website
Inappropriate use: By creating an account on the Conversation Cards website, you agree to refrain from using inappropriate, profane, offensive, or discriminatory language in your account.
Illegal Use: By creating an account you agree not to use the Services for or in the pursuit of illegal purposes. Neami cooperates with the authorities in investigations into illegal internet use and complies with requests for information from government where legally obliged to do so such as in the case of a Coroners Court investigation.
Neami will take both criminal and civil legal action against Users who use the Services in an unlawful way. You agree not to directly or indirectly allow a third party to use the Services in an illegal or unsuitable manner.
Harassment: By creating an account you agree not to use the Conversation Cards website for harassment¸ threats¸ verbal abuse¸ and/or persistent unwanted contact(s) of any kind. Harassment can be active¸ in forms including but not limited to unwanted emails¸ and/or chat messages¸ and/or verbal declarations on a public forum¸ and can be passive in the form of defamatory information posted on web sites.
Access to another User’s account information:
Persons creating a “Professional account” agree to removing access to participants account information and responses when the participant (their client) requests them to do so or their relationship is terminated (such as when they no longer have a service agreement, or client-to-patient service is ended).
Professionals also agree not to manage another users account such as holding their password or changing their information without their consent.
Professional users agree to honour any external service agreement, consent requirements, privacy policies or legal documentation in place that is required between them and another party, such as a client or individual who uses their services.
Hacking: You agree not to make any attempt to disrupt or attack the services or systems provided by the conversation cards, including any deliberate attempt to interfere with another user’s ability to take advantage of the service offered online.
Reselling: You may not resell the services or redistribute or reconfigure the services to allow others to use the services in an illegal¸ fraudulent or inappropriate manner. Interpretation of this clause will be at the sole discretion of Conversation Cards and Neami National.

Functionality: Neami makes no representations or warranties that the information contained within the website or the functionality of the website, and/or attached third party material is suitable for your needs. Neami aims to continually address and improve the accessibility of its services and products but makes no warranties that it meets all the accessibility requirements of all people.
Health information: Any information provided by Neami through the website relating to mental or physical health and wellbeing is not intended to be a substitute for professional mental or physical health advice, diagnosis, or treatment.

Third party behaviour: Neami takes no responsibility for the behaviour of any third parties, such as other service providers or family members who you chose to share your account with or any third party applications, products or software used in the development of the website.

Your Account: If you create an account with the website, you will be responsible for maintaining your ‘User’ information, including username and password securely. You agree to accept responsibility for all actions that occur with your username and password.

Entire Agreement
These Terms of Use, together with the Privacy Notice referred to in it, constitute the entire agreement between you and Neami relating to this website.
